1. Agreement to Terms
Welcome to the Ascent Psychiatry website (the “Site”). These Terms and Conditions (“Terms”) govern your access to and use of the Site operated by Ascent Psychiatry LLC (“Company,” “we,” “us,” or “our”), a virtual concierge psychiatry practice based in the Commonwealth of Pennsylvania.
By accessing or using the Site, you agree to be bound by these Terms, our Privacy Policy, and any additional terms referenced herein. If you do not agree with any part of these Terms, you must not access or use the Site.
2. Description of Services
Ascent Psychiatry provides virtual (telehealth) concierge psychiatric services to patients in the Commonwealth of Pennsylvania. Through our Site, you may access information about our practice, request appointments, communicate with our team, and access patient portal features.
Important: The information provided on this Site is for general informational purposes only and does not constitute medical advice, diagnosis, or treatment. The content on the Site should not be used as a substitute for professional psychiatric or medical advice. Always seek the guidance of a qualified healthcare provider with any questions you may have regarding a medical or psychiatric condition.
3. No Doctor-Patient Relationship
Merely accessing or browsing the Site does not create a doctor-patient or therapist-patient relationship between you and Ascent Psychiatry or any of its providers. A doctor-patient relationship is only established through a formal agreement, intake process, and acceptance as a patient by one of our licensed providers.
4. Telehealth Services
Ascent Psychiatry delivers psychiatric services via telehealth (audio and/or video conferencing). By using our telehealth services, you acknowledge and agree to the following:
a) Geographic Limitations
Our providers are licensed to practice in the Commonwealth of Pennsylvania. You must be physically located in Pennsylvania at the time of your telehealth appointment.
b) Technology Requirements
You are responsible for ensuring you have the necessary technology, including a device with audio/video capabilities and a stable internet connection, to participate in telehealth sessions. If your connection is lost during a session, your provider will attempt to reconnect with you. If reconnection is not possible, your Care Navigator will contact you to reschedule.
c) Informed Consent
By enrolling in telehealth services, you acknowledge that you have been informed of the benefits, risks, and limitations of telehealth; that you have the right to refuse or discontinue telehealth services at any time without affecting your right to future care; that all existing confidentiality protections apply equally to telehealth services; and that you have the right to access your medical records from telehealth sessions.
d) Limitations of Telehealth
You understand that telehealth has limitations compared to in-person care and that our providers will determine whether telehealth is appropriate for your clinical needs. In some cases, an in-person evaluation or referral may be recommended.
e) Session Recording
Telehealth sessions are not recorded by Ascent Psychiatry unless required by law or with your express written consent.
f) Emergency Situations
Telehealth services are not appropriate for psychiatric or medical emergencies. If you are experiencing a medical or psychiatric emergency, call 911 or go to your nearest emergency room immediately. You may also contact the 988 Suicide and Crisis Lifeline by calling or texting 988. As part of your intake, you will be asked to provide emergency contact information and your physical location so that emergency services can be dispatched to you if needed. It is your responsibility to keep this information current.
5. Concierge Model
Ascent Psychiatry operates on a concierge (direct-pay) model. By enrolling in our services, you agree to the following:
a) Fees
Our fees and service charges are outlined on the Policy page of our website. All fees are subject to change with advance written notice.
b) Insurance
Ascent Psychiatry does not accept insurance for psychiatric appointments. However, you may use your insurance to pay for medications and lab tests that are part of your treatment plan. We may provide you with documentation (such as superbills) that you can submit to your insurance company for potential out-of-network reimbursement of appointment costs; however, we make no guarantees regarding reimbursement.
c) Payment
Payment is due in accordance with the terms set forth on the Policy page of our website. We reserve the right to suspend or terminate services for non-payment.
d) Cancellation and Refunds
Cancellation and refund policies are outlined on the Policy page of our website. Please refer to that page for specific terms.
6. Eligibility
You must be at least 18 years of age to use this Site and our services independently. We provide clinical services for patients ages 5 and older. Services for minors (under 18) require parental or legal guardian consent and are subject to the discretion of our providers and applicable law.
7. User Accounts
Certain features of the Site may require you to create an account or access a patient portal. You agree to:
a) Provide accurate, current, and complete information during registration.
b) Maintain the security and confidentiality of your login credentials.
c) Notify us immediately of any unauthorized access to or use of your account.
d) Accept responsibility for all activities that occur under your account.
We reserve the right to suspend or terminate your account at our discretion if we believe your account has been compromised or you have violated these Terms.
8. Privacy
Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy. The use and disclosure of your protected health information (PHI) as a patient is governed by our Notice of Privacy Practices, which complies with the Health Insurance Portability and Accountability Act (HIPAA) and applicable Pennsylvania law.

9. Data Breach Notification
In the event of a breach of unsecured protected health information, Ascent Psychiatry will notify affected individuals in accordance with HIPAA and Pennsylvania law. Notifications will be provided without unreasonable delay and no later than sixty (60) days following discovery of the breach. If a breach affects 500 or more individuals, we will also notify the U.S. Department of Health and Human Services and provide notice through prominent media outlets as required by law.
10. Prescription Medications
If our providers prescribe medication as part of your treatment, you agree to the following:
a) You will provide complete and accurate information about your medical history, current medications, allergies, and any other relevant health information.
b) You will take prescribed medications only as directed and will notify your provider of any adverse reactions or side effects.
c) You understand that prescribing decisions are at the sole clinical discretion of your provider.
d) Controlled Substances
Certain medications, including but not limited to controlled substances, may have additional requirements, limitations, or monitoring protocols as required by the U.S. Drug Enforcement Administration (DEA) and Pennsylvania law. These may include periodic in-person evaluations, drug screening, or other clinical assessments at the discretion of your provider.
e) Prescription Drug Monitoring
Our providers participate in the Pennsylvania Prescription Drug Monitoring Program (PDMP) as required by law. Your prescription history may be reviewed through the PDMP before medications are prescribed or refilled.
f) Pharmacy and Insurance
Prescriptions are sent electronically to the pharmacy of your choice. You may use your health insurance to cover the cost of prescribed medications and any laboratory tests ordered as part of your treatment.
11. Intellectual Property
All content on this Site, including but not limited to text, graphics, logos, images, audio, video, software, and the overall design and arrangement thereof (collectively, “Content”), is the property of Ascent Psychiatry LLC or its licensors and is protected by United States copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, display, perform, or otherwise use any Content without our prior written consent, except for personal, non-commercial use in connection with accessing the Site.
12. Prohibited Conduct
When using the Site, you agree not to:
a) Use the Site for any unlawful purpose or in violation of any applicable law or regulation.
b) Impersonate any person or entity or misrepresent your affiliation with a person or entity.
c) Interfere with, disrupt, or attempt to gain unauthorized access to the Site, its servers, or connected networks.
d) Transmit any viruses, malware, or other harmful code.
e) Collect or harvest personal information of other users.
f) Use automated means (bots, scrapers, etc.) to access the Site without our written permission.
g) Engage in any activity that could damage, disable, or impair the Site.

TO THE FULLEST EXTENT PERMITTED BY LAW, ASCENT PSYCHIATRY LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any Content on the Site.

15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ASCENT PSYCHIATRY LLC, ITS OWNERS, PROVIDERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE EXCEED THE AMOUNT YOU HAVE PAID TO ASCENT PSYCHIATRY LLC, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Nothing in these Terms is intended to limit liability for medical malpractice or any liability that cannot be excluded or limited under applicable law.
16. Indemnification
You agree to indemnify, defend, and hold harmless Ascent Psychiatry LLC, its owners, providers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) your violation of any applicable law or regulation.
17. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions.
Any disputes arising out of or related to these Terms or your use of the Site shall be resolved through good-faith negotiation. If the parties are unable to resolve the dispute through negotiation, either party may pursue resolution in the state or federal courts located in the Commonwealth of Pennsylvania, and you consent to the personal jurisdiction of such courts.
18. Changes to These Terms
We reserve the right to modify or update these Terms at any time, at our sole discretion. If we make material changes, we will update the “Last Updated” date at the top of this page and may provide additional notice through the Site or by email. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms.
19. Termination
We may terminate or suspend your access to the Site, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Site will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, limitations of liability, and indemnification.
20. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
21. Entire Agreement
These Terms, together with our Privacy Policy, Notice of Privacy Practices, and the policies published on our website, constitute the entire agreement between you and Ascent Psychiatry LLC with respect to your use of the Site. These Terms supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and Ascent Psychiatry LLC regarding the Site.
